Terms of service

1. Scope

These general terms and conditions apply to all orders placed through the Ikigo online shop at ikigo.eu. They apply to consumers and to business customers. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

3. Conclusion of contract

The presentation of the products in the online shop is not a legally binding offer but an invitation to order. By clicking the button "Zahlungspflichtig bestellen" (order with obligation to pay) in the final step of the ordering process you submit a binding offer to purchase the goods in your cart. The order confirmation by e-mail merely documents receipt of your order. The contract is concluded when we accept your order by sending a shipping confirmation by e-mail or when we deliver the goods, at the latest within five days.

4. Contract text and contract language

We store the contract text and send you the order data and these terms and conditions by e-mail. The contract language is German.

5. Prices and shipping costs

All prices stated are final prices. Under section 19 UStG no value added tax is charged or shown (small business regulation). Any additional shipping costs are clearly shown to you during the ordering process before you place the order.

For deliveries to countries outside the European Union you are the importer of the goods. We deliver there unpaid of duty, under the delivery term DAP (Delivered at Place, Incoterms 2020). Customs duties, import charges and the carrier's customs clearance fees are not included in the purchase price or in the shipping costs and are to be borne by you. Our shipping policy sets out the details.

6. Payment

Payment is made through the payment methods offered during the ordering process, currently credit card, Apple Pay, Google Pay and Klarna via Shopify Payments as well as PayPal. The purchase price falls due on conclusion of the contract unless the chosen payment method provides otherwise.

7. Production and delivery

Our products are made to order. The current production time is stated on the respective product page. The delivery time consists of the production time plus the shipping transit time. We deliver to Germany, to the countries of the European Union and to Switzerland, Liechtenstein, Norway, the United States and Canada. The country list in the checkout is authoritative. For deliveries outside the European Union the delivery time is extended by the duration of customs clearance in the country of destination, over which we have no influence.

8. Passing of risk

For consumers, the risk of accidental loss and accidental deterioration of the goods passes to you only on handover of the goods, irrespective of the shipping method chosen. For business customers, the risk passes on handover to the carrier.

9. Retention of title

The goods remain our property until payment has been made in full.

10. Right of withdrawal

Consumers have a statutory right of withdrawal. The details follow from our withdrawal instructions. The right of withdrawal does not exist for goods that are made to customer specification or are clearly tailored to personal requirements (section 312g (2) no. 1 BGB), in particular for products with individual engraving. You may also declare your withdrawal through our electronic withdrawal function at ikigo.eu/pages/widerruf.

11. Warranty

The statutory rules on liability for defects apply. For consumers the limitation period for claims based on defects in new goods is two years from delivery. Our products are made from natural materials. Variations in grain, colour and structure of wood and slate are inherent in the material, form part of the agreed quality and do not constitute a defect.

12. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body and health, under the provisions of the German Product Liability Act, and within the scope of any guarantee we have given. In the case of slightly negligent breach of an obligation whose fulfilment is essential to the proper performance of the contract and on whose observance you may regularly rely (cardinal obligation), our liability is limited to the damage foreseeable at the time the contract was concluded and typical for this type of contract. In all other respects liability for slight negligence is excluded.

13. Consumer dispute resolution

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration body (section 36 VSBG).

14. Applicable law and place of jurisdiction

German law applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. If you are a consumer with your habitual residence in another state, the mandatory consumer protection provisions of that state remain unaffected by this choice of law. In dealings with merchants, legal persons under public law or special funds under public law, the place of jurisdiction is our registered place of business.
